Most people prefer to file a Chapter 7 case and be done with their debts.  However, in some situations, outlined below, a Chapter 13 case delivers the best outcome.  In Chapter 13 bankruptcy, you repay (usually) a portion of your debts over 3 to 5 years according to a written plan.  The exact monthly payment depends your income and your property.  When you make the last plan payment, usually, the debts will be only partially paid.  However, magic of Chapter 13 is that the remaining portion will be discharged.  As in Chapter 7 bankruptcy only dischargeable debts will be discharged.

So in what situations is it best to file a Chapter 13 case?
